Florida Divorce by Publication | Attorney Carrera's Lunch Break
When one spouse wants to call it quits, but cannot find his or her missing spouse, or when he/she is hiding, a Florida divorce by publication comes into play. A divorce by publication in Florida happens "only after a judge has been convinced, based on a sworn declaration, of the serving party's inability to find the Defendant after trying hard. Service by publication is commonly used in a divorce action to serve a spouse who has disappeared without a leaving a forwarding address..."
When the Respondent cannot or will not be found (and, therefore, cannot be served by a Deputy Sheriff or a private process service or by certified mail), the Petitioner must conduct what is termed a "diligent search" followed by Service by Publication. Florida courts require a good faith effort by the Petitioner to prove that he or she has made a genuine search for his or her missing partner. "Service by publication is only available when the Respondent's whereabouts is unknown in spite of diligent effort by the petitioner to find the respondent's address."

In the aftermath over peaceful protest turned violent destroying property one must ask who pays for the damaged vehicles? In this video it will be explained the different types of coverage basically if you have no insurance, you're **** out of luck. I went to Ochopee, Florida (Loop Road) to visit lucky Cole at Lucky’s Speakeasy, which is in the middle of the Florida Everglades. I have been there before but the last time I was there I rode down with the US Military Vets MC of Fort Lauderdale in 2012. Shame on me for not coming down earlier! It was great as I pulled into his secret, no cell phone signal, compound in the middle of the Florida swamp. I had to do some logistics and check out the electricity for the band Southern Blood that will be plain. Towards the end of my visit I sat down with Lucky and a few other of his guests. He told this incredible story about his youngest son's wedding. This was not a shotgun wedding, but there were gunshots in a way that only lucky can explain through his storytelling. Up-Date: Motorcycle Ride For Life Sunday June 14 @ 10 AM
Sunday June 14, 2020 at 10:00 AM we are meeting at the Brus Room Pompano. There will be plenty of parking and a tiki Hut with a bar available to serve adult beverages for those that come. Kickstands up at 11:00 AM. Everybody is doing their own ride it is not a police-escorted ride. Some folks are riding down individually (riding solo). Other people are riding in groups, their MC’s, or their rider’s associations. We encourage everybody to follow the law and especially do not block traffic to allow motorcycles through the intersections. We want everybody to arrive alive at lucky Coles Speakeasy oh choppy Florida in the Everglades.
There we will have a memorial service starting at 2:30 PM lasting about 15 minutes. There will be live rock music lots of bikers in the Everglades. For more information please go to South Florida bikers on the Facebook group page, go to the left side click events and find our event for June 14th. Gov DeSantis Extends Evictions and Foreclosures Moratoriums Until June 2, 2020

Florida Gov. Ron DeSantis extended the freeze on residential evictions and foreclosures until June 2.
The governor’s emergency order, giving homeowners and renters more time in their homes if they can’t make their mortgage or rent payments due to the pandemic, was set to expire in the coming days. The executive order extending that provision, signed on Thursday, does not provide financial relief to renters and homeowners, but prevents them from being evicted or foreclosed on until June 2.
The delays, in fact, could lead to a stream of evictions and foreclosures in June, when lenders start filing foreclosure actions against homeowners and landlords seek to evict residents who have lost their jobs and are unable to pay rent, experts say. Two million people have filed for unemployment in Florida since the pandemic began. Thousands of workers in South Florida’s hospitality and retail sectors have been laid off as many businesses were forced to close.
DeSantis’ original order was issued in early April. Miami-Dade County Mayor Carlos Gimenez suspended all eviction activity in mid-March. On Monday, some non-essential businesses in Miami-Dade and Broward counties will be allowed to reopen.

Gabe's Florida Attorneys' Guide: A Hack To Liability Insurance Disclosure mandated by law. Sometimes lawyers find them selves being tested by the insurance company their client has a claim against. The Adjuster plays 3-card Monty with the wrong-doer's policy limits and delays disclosure. What is a young attorney to do or a person representing them selves in the Personal Injury process.
I have been in this situation a few times a year. On average, adjusters are serious and professional when working their claims. I have worked with some highly ethical adjusters in my 15-years practice. Every once in a while you get a slippery one that wants to impress the boss and that adjuster takes short cuts that stalls your case.

Why Can't The Florida Legislature Protect The Biker Community in 2020? My staff and I got into a conversation that needed to be heard by the Florida Legislature in Tallahassee.
For too long and too often I get motorcyclists that walk through my door seeking out my legal services. When I get a copy of the at fault party’s insurance either they have NO COVERAGE for bodily injury or a mere $10,000. This leaves the biker shit out of luck cause most of the time they have no assets to go after. You cant get blood out of a rock. It’s hard enough with the insurance companies trying to obtain proper compensation for fallen bikers.
The Florida Legislature MUST pass laws to protect Bikers and their families from losing all because some greedy Cager refuses to carry the proper insurance coverage!

As you may already know that the 30-Hr Ironman LDR motorcycle Rally is an Iron Butt Association "STYLE" rally. Although we are NOT affiliated with the Iron Butt Association we would like to be. Thus we are making a major overhaul to the run so that in Feb 2020 we can offer this to more riders that LIKE to ride these LDR runs.
Its $100 to register and that buys 2 families a completely cooked Thanksgiving Dinner Turkey, 3-sides and a pie for $50 per family feeding a family of five. The turkey comes cooked so they only have to warm it up. This is through the American Legion Post 180 that works with other posts in South Florida.

Insurance companies for some reason, either knowingly or unknowingly, mess with the claimant in my opinion. They will add the repair shop to their insurance settlement case for no legal reason. This also happens when at fault insurance companies send a check to the claimant with their name and the hospital name on same check. This is not right and you must demand nicely that they re-issue the check in your name. On property damaged motorcycles or cages the insurance company MUST add bank as payee if they have a lien on the bike. The motorcycle is the collateral for the loan and they are trying to make sure you don't take the cash and dump the bike afterwards.
