Ken Johnson, Restorative Justice Facilitator - Who Wrote That Up For You? Jul 25, 2023

Ken Johnson, juvenile justice expert and certified Florida mediator, discussed the potential of restorative justice practices to mitigate the severe harm to young people caught up in the school-to-prison pipeline. With a new academic year starting, Ken wanted to the reasons behind the shocking statistic that 4 out of every 5 incarcerated adults started out in the juvenile justice system. According to Ken, this is all by design and is part and parcel of the culture's punitive attitude toward children.

Ken described the coincidence of standardized testing schedules and high rates of at-risk youth arrested at school, which tends to raise a school's test scores and secure more funding for the school because low scorers are removed from the test pool. He also discussed the stark racial disparities both in arrest rates and in levels of violence exacted upon incarcerated youth. He shared the well-documented story of the "Whitehouse Boys" and the horrors perpetrated by law enforcement and guards at the now-defunct prison in Marianna, Florida. Ken decried the lack of criminal penalties for these and other abuses due to law-enforcement immunity from prosecution.

Ken also discussed the commonplace labeling of certain neighborhoods as "million-dollar blocks." These are city blocks with so many arrests that nearly $1M dollars is lost annually due to lack of productivity, criminal background-related unemployment, and other consequences of a carceral state. Ken sees these problems worsening in the future without activism because the incentives for punishing youth are so entrenched.

Kristin Henning, Georgetown Law - Who Wrote That Up For You? Feb 15, 2023

Kristin Henning is the Blume Professor of Law and director of the Juvenile Justice Clinic & Initiative at Georgetown Law. She is also the author of "Rage of Innocence: How America Criminalizes Black Youth," which draws upon her twenty-five years of experience representing Black youth in Washington, D.C.'s juvenile court to detail the myriad ways police encounters are used to deny Black youth the healthy adolescent development afforded to other young people.  

Professor Henning teaches and trains lawyers, judges, prosecutors, and others about the criminalization of Black and Brown youth to help mitigate the implicit racial bias in the juvenile justice system. She offered tips for parents whose children have been arrested to keep them from being targeted for incarceration. She expressed special concern for Black and Brown students with disabilities because their normal behaviors are often perceived as threatening during police encounters, leading to higher rates of removal from their families and communities.

J. Rich Leonard is the dean of the Norman Adrian Wiggins School of Law at Campbell University in Raleigh, North Carolina. Dean Leonard described the work of Campbell Law's numerous pro bono clinics, including a partnership with the City of Raleigh to mitigate evictions and arbitration services provided to Wake County and local municipalities to resolve discrimination complaints out of court. He also discussed his new book, "From Welcome to Windhoek: A Judge's Journey," charting the journey from his hometown of Welcome, North Carolina to consulting with judiciaries in southern Africa.

Tiffany Graves, Pro Bono Counsel at Bradley - Who Wrote That Up For You? Jan 27, 2023

Tiffany Graves is the first pro bono counsel at Bradley Arant Boult Cummings, LLP, the largest law firm in the southeast U.S., with over 600 attorneys serving the banking, construction, energy, and healthcare industries. ("Pro bono" means "for the good" or free of charge.) Each attorney at the firm provides a minimum of 50 hours of free legal services annually to people who cannot afford an attorney. Tiffany's role is to ensure opportunities for pro bono service are available when an attorney at the firm is ready to serve.  

Tiffany's legal career has been devoted to closing the justice gap between those who can pay for representation and those who cannot. She is a former director of the Mississippi Access to Justice Commission. Prior to that, she ran the Mississippi Volunteer Lawyers Project. Tiffany shared the importance of pro bono service for both the legal profession and the larger society. She also advised that people needing free legal services should contact their local legal aid office for a referral to firms like Bradley.

Daniel Medwed is a distinguished professor of law and criminal justice at Northeastern University School of Law and the author of "Barred: Why the Innocent Can't Get Out of Prison." He shared the procedural hurdles faced by the wrongfully convicted in getting new trials, even when they have proven their actual innocence. The criminal justice system values the finality of criminal trials over all else, including the liberty of innocent people. Daniel argued that problems are found in both the trial process, where poor defendants and their public defenders are unable to match the resources available to state prosecutors, as well as in the post-conviction rules that apply when seeking review of trial procedures.

Professor Medwed is a founding member of the Innocence Network, a global consortium of innocence projects working to free the wrongfully convicted. He also serves on the board of the New England Innocence Project. He described the three-phase process used by innocence projects in deciding which cases to pursue and working to free prisoners in the cases they take on. He also stressed the need for concise facts and simplicity in applications for assistance from Innocence Projects.

TurnSignl allows drivers to bring a local attorney into interactions with police and plans for nationwide availability in 2023.

Katherine Alteneder is the coordinator of the Self-Represented Litigation Network (SRLN), a group of lawyers, law professors, court administrators, and other professionals dedicated to improving outcomes for pro se litigants. Melissa Franca and Emma Hawley are law students (3L and 2L, respectively) at the University of Wisconsin School of Law. They are currently enrolled in the school's Law & Entrepreneurship externship course, led by previous “Who Wrote That Up For You?” guest, Professor Charles Von Simson. The course pairs them with startup companies and entrepreneurs, and the two students have chosen to complete their externship this year with Courtroom5.  

Melissa and Emma both shared their aspirations to help people as the motivating factor in joining the legal profession. The curriculum has helped them understand the complexity of the law and has driven their interest in using technology to increase access to the courts. At Courtroom5, they've learned a lot about the litigation process and ways to simplify rules and procedures so laypeople can understand and use them. They described their Courtroom5 project -- to help pro se litigants specify discrete unbundled services for lawyers -- as something that has improved their understanding of the practice of law.

Olivia Miller, a junior partner at the Chad Barr Law Firm in central Florida, described the pro se litigants she sees in small claims courts. In her experience, judicial assistants and clerks offer valuable information to help pro se litigants understand the process. Judges go the extra mile to ensure pro se litigants have time to express themselves and get a fair hearing. Still, most pro se litigants are disadvantaged because their opponents are represented by counsel, and lawyers know how to navigate those procedures at a higher level. Olivia advised pro se litigants to visit the court's website to find forms and basic instructions. She also recommended they spend time reviewing resources designed for lawyers, such as administrative orders and the preferences of their assigned judge.

Brian Vudkadinovich, author of "Motion for Justice: I Rest My Case," made a surprise appearance on the show to help close the first season, which ends tomorrow. Brian praised Olivia's candor and advice. He also argued that lawyers shouldn't be allowed in small claims courts, but it's unavoidable because many states require governments and corporations to be represented by legal counsel. Given the choice between guaranteeing everyone a lawyer and simplifying court procedures to make it easier for laypeople to represent themselves, Brian chose the latter. Brian believes the courts should be available to everyone on an equal basis, whether they have a lawyer or not.

Patti Mazurkiewicz is a nurse and certified life care planner. She described the use of life care plans in personal injury litigation and the process of creating them. She explained that certification to become a life care planner includes courses and exams on the purposes, procedures, and ethics of estimating the medical and other needs of an injured person for the remainder of their life. Life care planning is used by both plaintiffs and defendants involved in personal injury litigation. While most parties seeking life care plans are represented, there is a significant number of pro se litigants amongst the clientele.

Rae Lynn Christians is a registered nurse and founder of Integrity Nurse Consulting and Life Care Planning. She explained the difference between life care planning and medical cost projections, a simpler and less expensive estimate of the needs of an injured person. Medical cost projections are often the first step in the life care planning process and are more often used to drive early settlements in personal injury cases. Rae Lynn is sometimes used as an expert witness when life care plans become part of trial evidence.

David Emanuel is a private investigator and owner of I FIND U Investigations in South Florida. David shared the career trajectory that led him to focus on asset location and recovery and other private investigation work. He sometimes serves as an expert witness but more often sees his clients settle cases with the results of the evidence he finds. David does tons of pro bono work for pro se litigants and friends.

Kenn Goldblatt, author of "The Pro Se Litigant's Civil Litigation Handbook," discussed his background as a paralegal and pro se civil litigant, and his desire to help others by sharing his knowledge. Kenn shared the benefits of the book for people handling their own litigation, including understanding the process and some of the options at each phase of a case. He often provides direction and services to pro se litigants who reach out to him for help. The book, published in 2016, is available at Amazon, Barnes and Noble, and AuthorHouse.

Attorney Doug Noll left the practice of law to honor his preference for making peace over war (litigation). Doug became a mediator, helping parties in litigation settle their differences without going to trial. He shared a recipe for reducing conflict and calming the anger that many people bring to mediation, called "affect labeling" or calling out a person's emotion so they feel seen. Doug also shared advice for settling a claim as a pro se litigant, including starting the mediation process as soon as possible, understanding that it doesn't require anyone to accept a bad deal.
