A contract is a written or spoken agreement especially one concerning employment, sales or tenancy that is intended by law.
They are formal and legally binding.
A contract is an explanation of what you will be doing, the terms of how you will be doing it and the customer’s/client’s obligations and yours.
Why do creative need to have written contracts for the services they provide?
Often time creatives get the short end of the stick because there is no agreement and clarity with the services they provide for the client.
Due to the nature of creative work, when a client is unhappy with the final product they feel like they can ask for a refund. Not that refunds are wrong but creatives usually don’t have refund policies.
Contracts help in protecting your intellectual propert.
Benefits of having contracts:
There is clarity in business relationships, agreements, and rights of the parties involved.
They help in preventing misinterpretation of communication and agreements.
They help in protecting intellectual property.
They provide tangible proof of what was agreed upon between you and the client.
What makes a contract legally binding?
Consensus- there must be a meeting of minds with regards to obligation and performance. Both parties must be aware of the agreement.
Capacity- both parties must have the required capacity to sign a contract. This relates to age and mental clarity.
Something of value must be exchanged for something of value. For example your services for money.
The contract must be signed by both parties.
Basic elements of a Contract:
Title: The document needs a title that defines the type of document.
Preamble: The preamble is used to highlight the important details of the document. This caninclude the date of execution and information of both parties.
Parties: The contract needs to provide all information regarding the parties involved. Thiswould be name, contact details and other details of the parties.
Agreement: Any contract is not complete and binding without the agreement of all parties. The parties need to agree on terms of the contract as well as the value of exchange before signing.

Timeline of project
Cancellation Policy
Refund Policy
In the creative world contracts can feel very constricting. Yet contrary to popular belief, contracts can protect both you and the client. You can customize your contracts to include whatever works for you. Unfortunately not everyone can afford a lawyer hence we are providing these contractual basics. You might find administrative tasks frustrating but truth is admin makes the greater difference it helps you run your business smoothly. Invest in contractual agreements to prevent potential problems.

In 2019, 13 774 suicides were reported in SA. Of these deaths, 10 861 were men while 2 913 were women. South Africa recorded the third-highest suicide rate out of all African countries- From the WHO (World health organisation)

EP25 | Things I Wish I Knew As A Beginner Photographer
I have learned so much from YouTube, industry friends and from having a keen interest in the photography field and I feel it is only fair that I share what I have learned.
Here are the things I wish I had know earlier:
Learn ISO, Aperture and Shutterspeed.
Use what you have around you, whether it's a phone or an object like a lamp.
Shoot manual mode.
Learn composition.
Use the sun as your light source, shoot at golden hour and invest in a diffuser.
Know your equipment, you should aim to be able to operate it in the dark.
Let go of the pop-up flash on your camera, use an external flash.
Gear is not everything, google Luisa Dörr, a Brazilian photographer who photographed exceptional women using her smartphone.
Shoot RAW, it gives you more flexibility when you edit your photos in Photoshoot or Lightroom.
Learn videography and audio, it is an amazing skill to have on your side.

From my experience pricing is personal, there are people who mange to build their portfolio up so much that they are able to charge that price, we are all different and at different stages in our careers to compare pricing. The belief that your clients determine your pricing is true, where you are situated, what your skill level is and who your clients have worked with play a major role in the client determining the price range. With all that said, let’s dive in to how I am going to be pricing myself and my services going in the 2022.
For the most part of 2021 I was charging per hour rates, I was ranging between R1200 to R1800 per hour depending on what I was photographing. I came to a stumble a few times when the hourly rate did not make sense, I could see it and so could my clients. This led me to rethink how I want to charge going forward, I must admit this is not something that is set in stone because things happen, i.e covid.
Going forward my pricing is going to be project/brief based, I will need to determine a few things before I am able to quote my clients. This will help me from underpricing or over pricing my self out the market. There are basic rules that I must still follow like factoring in equipment hire (camera, lens, flash, memory card), travel costs, project management, post production and lastly usage rights. These are costs that vary but must be accounted for in most cases, project management is one of the line items we often overlook because it’s pat of our job. Having worked at 3 media agencies before going full time in photography, everything has to accounted for if you are growing a business and let me tell you good photos are always needed by agencies.
The project/brief scope will determine the rest of the pricing, what is required of you to execute the photoshoot? Do you need a studio, how many photos are required, where will they be used, do I need an assistant, extra equipment that you do not own, a project manager. These are the questions that I will most likely ask the client to find out what is needed of me, nothing worse than undercharging and realising that the work is way more than you expected. You feel cheated, well at least that is how I have felt after realising that I have undercharged because I was using my hourly rate to get too my pricing.
Remember to negotiate copyright to the photos with your client, I find this has helped me monetise my photos better on stock photo website. We both share the copyright or commercial copyright to the photos. Ask your client questions that will help you find their pain points, this way you will be able to add value to them knowing what it is that bothers them most and need your help on the most.
Once I have all the information I need I am now able to quote according to the project/brief and I deliver knowing what is expected of me. The last thing to do is draft an agreement, this doesn’t have to be looked at by a lawyer but an agreement that you both agree on according to how you will work and deliver the work.

I was not aware the platform had a blackout so I went on twitter to check what is happening, twitter is always in the know and rightly so it was all over twitter that Mark shut us all down. lol.
This tells me that as a photographer or creative, you should really house your content somewhere else were you have control of your platform. Having your own website is critical and in fact it is recommended, I do not have one now because I chose to open a portfolio with Color Space where I am able to control and monetise my photos.

EP19 | 24hrs or NOTHING
In the beginning of my photography career I used to want to do everything myself when it came to client bookings.
Fast forward a few years later with much more experience I now take an assistant with me to ease the load of planning a photoshoot, carrying equipment, setting up, shooting, editing and retouching.
Taking an assistant with me to photoshoots has improved my turn around time from 2 days to 24hrs, I am now able to focus on what I am really good at and delegate other tasks to the assistant. No one cares about event photos 2 days later, in the age of smartphones with great cameras it is now easier to take a photo, edit it and post it all from your phone. Is that a threat to you and have you adjusted your turn around time to suit this?
