Fighting for Justice for Dr. Bockoff and His Chronic Pain Patients

My name is Kristen Ogden and I advocate for chronic pain patients. My husband, Louis Ogden, is one of the chronic pain patients I’m talking about. Consider the fact that Louis has suffered from pain since he was a child. Some of you already know the background of our efforts to intervene in the case of DEA vs. Dr. David Bockoff.

If you have pain, or you know someone who does, or fear some day you will have pain, as we all age, then you may want to consider what we’re doing in court. The why of our cause is straightforward. We are seeking justice for doctors to use their skills and justice for pain patients who desperately need relief from unremitting pain. In our fight with the DEA administrator and the relevant courts, we knew we had to retain counsel. When I first spoke to John P. Flannery, a former federal prosecutor, and special counsel on the Hill, and trial lawyer for decades, Mr. Flannery asked what outcome did we wish. Without hesitation, I said, individually and collectively we want the right to be let alone, to have access to pain medications for my husband, Louis, and for all of these patients in the same straits. That’s what we want. Mr. Flannery launched our effort with our full support with a Motion to Intervene in the case of DEA vs. David Bockoff, as “interested persons,” suffering because Dr. Bockoff was cut off summarily from continuing our pain prescriptions. We hoped to get the prescriptions we needed for our unremitting pain, and to exonerate Dr. Bockoff so he could get back to work caring for his patients. Prescriptions for controlled pain medications can only be possible if there’s a qualified pain specialist to write the scrips … preferably one who is knowledgeable, compassionate, and who “gets it” about chronic pain and the patients who suffer from it. We filed the Motion to Intervene, and, as expected, the DEA Administrative Law Judge (ALJ) denied our motion.


Now we need more funds to continue our fight!

CSI:OPIOIDs (Clinical Context of Suicide Following Opioid Transitions) is a scientific research study to closely examine suicides that have occurred after prescription opioid dose reductions in patients with long-term pain. The team will look at 110-120 suicides, split between those individuals who were Veterans of the US armed forces and people who were not Veterans.


The CSI:OPIOIDs team will:

  • Compile a registry of people who have died by suicide following a reduction or stoppage in their opioid medication.
  • Perform in-depth, one on one interviews with survivors of individuals who have died by suicide after opioid transition to understand what led their loved-one to die by suicide, and review medical records when they are obtainable.
  • Identify factors common to these individuals prior to their death and suggest ways to reduce likelihood that future patients will die by suicide under similar circumstances.

The approach used in this study, psychological autopsy, offers a descriptive portrait of each death. The resulting insights will help health systems, policy makers, and prescribers make better decisions to prevent these tragedies. To the chronic pain and hospice patient communities:


I have lived my life in MN growing up the youngest of five. My Mom was trained as a nurse but she was a stay at home Mom. I graduated high school in 1976 and got my BS in Animal Science at the U of MN. I started graduate school but never finished. I have spent the last 25 years of my life devoted to breeding and showing English Setter dogs. I live by myself in Minneapolis. My health issues started with knee surgery in college and I had ductal carcinoma at age 27. Sadly I opted for implants and they caused many issues.


I went onto full time disability at age 36. I’ve been on LTOT since 1998. When I was going through the month of testing to find out why I was short of breath I started thinking that if the news wasn’t good at least I wouldn’t have to worry about losing access to my meds. How crazy is that to see a terminal diagnosis as a blessing. When they finally figured out it was AML and I have the worst mutations possible I knew I would choose hospice right away. My first hospice company was horrible. Their doctor drew a line in the sand and she refused to prescribe my OxyContin, and instead gave me MS Contin and cut my MME by 12%.


This put me into withdrawals. I was so sick from the meds. Even my pharmacist told the doctor that would put me into withdrawals. I fired that company and thankfully was put back on OxyContin. The new company has been bending over backwards to make sure I am as comfortable as I can be with the cancer that has spread to T11 and L3 and now my pelvis. I want to discuss end of life options, how we got to this place where even hospice patients are not guaranteed relief from their pain. It’s a crazy time and I’m afraid if we don’t start to see some change we will become an opioid free country as doctors will no longer be allowed to prescribe them.

Milissa is a college graduate with a bachelor degree in economics and played D1 tennis before moving on to the professional circuit. Due to many orthopedic injuries, she had no choice but to retire and began her business career in banking shortly thereafter. She's now a Vice President with a regional agency she's been with for over 30-years. Her work has allowed her to film commercials within the US and abroad, including Rwanda, London and Banff, Canada, just to name a few incredible locations.


Milissa's had many injuries from playing sports, particularly tennis - she's had over 22 surgeries including 12 to her knees along with both shoulders, foot, wrists, etc. Her predominant injury is to her spine, which resulted in a 3-level spinal fusion in 2017.

Dr. Stefan Kertesz is the principal investigator of CSI:OPIOIDs (Clinical Context of Suicide Following Opioid Transitions), a scientific research study that examines suicides after prescription opioid dose reductions in patients with long-term pain.


Beginning as a pilot study supported by UAB Heersink School of Medicine’s Department of Medicine, today it’s supported by a Veterans Administration grant under the title “CSI:OPIOIDs-V“.


The study’s purpose is to increase knowledge of the demographic, societal, and clinical factors that have led and may lead patients with pain to die by suicide after opioid reduction or stoppage.

Dr. Stefan Kertesz is certified in internal medicine and addiction medicine, has a 22-year history of delivering primary care for vulnerable populations such as the homeless, and an 18-year history of research funded by the National Institute on Drug Abuse and Veterans Administration on care and services for problems of addiction and drug use. An addiction scholar, Kertesz serves on multiple task forces and teams related to opioid safety. He also led a national petition that resulted in major changes to a planned policy set up by the Centers for Medicare and Medicaid Services.
