Connecticut recently passed Public Act 21-71 An Act Concerning Essential Support Persons And A State-Wide Visitation Policy For Residents Of Long-term Care Facilities which outlines resident’s need for health, safety, and well-being along with including primary and secondary essential support persons. 

In this short episode, Host Mairead Painter explains several vital points about residents' rights and how their voices and families helped this bill get passed. Looking to the future, there are hopes a similar bill will be passed on a Federal level.

In the second episode of Long Term Care Legislative Updates I am joined by return guest Cinnamon St. John from the Center for Medicare Advocacy to discuss the details of proposed legislation in Connecticut and on the Federal level.

We focus this episode on staffing challenges; wage disparities, pool agencies, consistency of quality care, turnover, and staff burnout. We are hoping to create transparency related to nursing home operations and each component of care. We discuss which issues have been ongoing and those who have appeared during the pandemic. 

Possible solutions we talk about are adding value to staff positions, appropriate pay, and adding back programs that allow employees to move up the career ladder.

Consumer Voice for Quality Long-Term Care

Lori Smetanka is the Executive Director of the National Consumer Voice for Quality Long-Term Care, the leading national nonprofit advocacy organization representing consumers receiving long-term care and services in nursing homes, assisted living facilities, and home and community based settings.  As Executive Director, Lori oversees and contributes to the organization’s policy, advocacy, and program activities; leads the organization’s fundraising efforts; establishes strategic partnerships with organizations and federal agencies working on issues related to the provision of long-term services and supports; and establishes the strategic direction of the organization.

From 2004 – 2016 she served as the Director of the National Long-Term Care Ombudsman Resource Center, providing technical assistance, training, and support to the 53 State and more than 570 local long-term care ombudsman programs across the country.  Prior to that role, Lori served as Law and Policy Specialist at the Consumer Voice, where she provided policy analysis, consultation, education, technical assistance, and training on long-term care issues.  She received a B.A. from Indiana University of Pennsylvania, and a J.D. from the University of Dayton School of Law.

Katie Cuas is currently a Transitional Care Nurse assisting geriatric adults and their families navigate through the healthcare system and connect them with services to improve their Culture of Health. She works collaboratively with care partners to create innovative and adaptive client plans of care. Katie also performs various community health outreach and education programs for the Center for Healthy Aging and also local community entities such as local YMCA and Senior Centers.

Essential Caregivers Act of 2021 HR 3733

This bill requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and nearby inpatient rehabilitation facilities to establish an essential caregivers program during a public health emergency.

What are we doing this year for the VOICES Forum is explained in this short bonus episode with Mairead Painter.

HISTORY OF VOICES FORUM

In September of 1996, nursing home resident and activist Carol Rosenwald, with assistance from the Ombudsman Program, began organizing residents across the state to advocate for improvements in the long term care system.  Carol envisioned a time when the “VOICES” of nursing home residents could be heard “beyond the walls” of their facilities.  She became the founder of the Statewide Coalition of Resident Councils and the driving force behind the first “VOICES” Forum in 1997.  As a large group of voting constituents, residents were able to speak directly with political leaders and public officials about important issues affecting their quality of life.

VOICES FORUM TODAY

The VOICES Forum is an annual event which provides an opportunity for Presidents of Resident Councils from around the State to gather and discuss issues and concerns in their homes. The Connecticut Long Term Care Ombudsman Program is the sponsor and partner of the Statewide Coalition of Presidents of Resident Councils and the VOICES Forum.  The Coalition of Presidents of Resident Councils is an organization of residents of long term care facilities who work together on the enhancement of the quality of their care and the quality of their lives.  The Long Term Care Ombudsman Program supports the Coalition in their efforts to effect positive change in larger systems such as local and state governments.

Medicare 101

Medicare 101

Medicare 101 presents expert information about Medicare benefits and navigating the system from Judith Stein and Kathleen Holt from Center for Medicare Advocacy. The discussion centers around your legal rights and how best to access them when entering a skilled nursing facility, what type of Medicare plans are available and which is best for you, and how advocacy is there for everyone.

Judith Stein is the Executive Director of the Center for Medicare Advocacy, which she founded in 1986. She has focused on legal representation of older people since beginning her legal career in 1975.

From 1977 until 1986, Ms. Stein was the Co-Director of Legal Assistance to Medicare Patients (LAMP) where she managed the first Medicare advocacy program in the country. She has extensive experience in developing and administering Medicare and related advocacy projects and conferences, representing Medicare beneficiaries, producing educational materials, teaching and consulting. She has been lead or co-counsel in numerous federal class action and individual cases challenging improper Medicare policies and denials – including, Jimmo vs. Sebelius, which is opening doors to Medicare coverage and access to care for people with longer-term and chronic conditions.

Kathleen Holt joined The Center for Medicare Advocacy in 2014 as Associate Director.  Ms. Holt began her career with CIGNA Insurance Company, developing insurance claim process improvement strategies.

After obtaining her M.B.A. in Healthcare Management from the University of Connecticut, Ms. Holt helped protect patient rights and expand patient services as a hospital administrator – first at New Britain Memorial Hospital in Connecticut, and then at Northwest Hospital in Seattle, Washington.  After obtaining her law degree from Seattle University in 1993, Ms. Holt became a Special Assistant United States Attorney for the U.S. Department of Health and Human Services in Seattle.  In that position, Ms. Holt authored health law opinions, litigated in federal court, and served as in-house attorney for administrative law judges.  In 1997, following the birth of her profoundly disabled second child, Ms. Holt founded a Seattle area law practice to advocate for the needs of older and disabled people.  She led this practice until her arrival at the Center for Medicare Advocacy.
