Negotiation is one of the most important skills for success in business and in life. But it's a skill we are rarely taught. For many of us, we develop our skills purely through trial and error. We see what works, discard what doesn't and if we're lucky, we'll have a few good mentors along the way.

In this podcast, I want to help you to build your skills in a more structured way. We'll give you a taste of negotiation theory and I'll be speaking with guests from a range of backgrounds to hear about their experience and give you access to an even greater range of negotiation mentors.

NIRL 49 - Ken Fehily - talking negotiation with Mr GST

In this episode of Negotiation in Real Life, I speak with Ken Fehily. Some of you might know 'Ken' as 'Mr. GST', a specialist accountant/economist who was one of the experts who assisted the treasurer and ATO write and implement the GST Law nearly a quarter century ago. He continues to specialize and advise the ATO, federal government, other professionals and businesses on GST, and tax reform.

He has over 3 decades of experience as a professional and non-exec director (often as chairman or treasurer) on government, industry, NFP and community boards and committees, across a wide spectrum of education, property, visual arts, museums, faith based organizations and is currently a volunteer first responder with SES rescue.

He spent decades as a senior international partner of the top global professional services firms, a sole practitioner since 2010, is a B.EC, FCAANZ, FCPA, CTA, GAICD, owned a contemporary art gallery, was married for 30 years and is a proud father of 4 inspiring children.

He's been rich, poor, homeless and owned a Toorak mansion. So one might say that over the years, he's been around, and remains persistently optimistic and enthusiastic.

Yet, despite his hard core disciplined side, 'Kenny' was also trained and exposed to matters involving the other creative and ‘feeling’ hemisphere of the brain and developed a warm, soft, understanding, gentle and empathetic side. That’s naturally led to him being sought out to coach, mentor and personally guide, formally or casually, a wide range of unique individuals, as unique as everyone around us all. Indeed, his testimonials range from a single Vietnamese boat refugee about in her 30s (he's never asked) through to a hard core conservative entrepreneurial board director in his 70s. It's unsurprisingly been described by some as a spirited and sometimes controversial persuader and negotiator.

NIRL 46 Jemimah Ashley - Reading people in a negotiation

In this episode of Negotiation in Real Life, I speak with Jemimah Ashleigh, an award-winning entrepreneur, best-selling author and keynote speaker. After a thirteen-year career in law enforcement, Jemimah left the Australian Federal Police and has since gone on to start multiple six figure businesses, release a best-selling book, win multiple awards and in 2022 was named one of Australia's top 10 entrepreneurs.

Jemimah states a lot of her success in business came from a career in law enforcement where she specialised in reading body language and micro expressions. Jemimah has worked with some incredible teachers such as Paul Eckman and has studied this for years.
Jemimah started in rural Victoria but she didn’t stop there. She hasn’t really stopped anywhere. Her first job, working as an analyst for the Australian Police of the back of a Bachelor of Science (Security) and post-graduate studies in Investigations and Criminal Intelligence, would have been enough for most people. Jemimah is not most people.

After meeting a silversmith in New York, she founded her own jewellery company, Tangs Design. As that went from a crazy idea, to a side project all the way to a stable company, she realised that she’d jumped in at the deep end of online promotion. As it turned out - she was pretty good at it!

Jemimah knew she wanted to educate people about business and went on to co-found The Business Experiment podcast which went on to become one of Australia’s fastest growing podcasts. Jemimah now exclusively works with people to do amazing expert at her business The Visibility Lab helping them get seen and featured in the media and getting massive exposure.  

She’s completed studies in Criminal Intelligence, speaks three languages and has extensive experience in teaching LGBTIQA+ issues in Government. Jemimah is a skilled actor and improvisor, is often found doing stand-up, blogging and writing.  

And she’s approached all of this with humour, passion, a fun loving attitude and enthusiasm.

NIRL 45 - Adam Montgomery on negotiating in the music industry

In this episode of Negotiation in Real Life, I speak with Adam Montgomery, the Founder, General Manager and Senior Booking Agent at Four Tone Artists. FTA is a Melbourne based booking agency that represents some of the best developing and established artists in Australia and New Zealand.

Adam started his career as a musician and for eight years was a member of the band Calling All Cars. The band had a successful career and were able to tour Australia and internationally on many occasions. Throughout this time, Adam acted at the band’s road manager. In this role he developed an acute understanding of the live touring landscape and established a deep knowledge of all facets that contribute to a successful tour and live business.

In 2015, Adam transitioned from musician to behind the scenes and started working as an agent at 123 Agency. While at 123 he quickly developed a reputation for signing new and breaking acts and began to experience success early in his career.

In May 2018, Adam took a giant leap and started his own agency, Four Tone Artists. Since its inception, FTA has seen considerable growth. Beginning with two employees and ten artists, the agency has grown to a team of five and now represents 40+ artists across all genres. While priding itself on being a boutique company, FTA is now the fastest growing agency in the country and is responsible for the live careers of world class artists that include: Slowly Slowly, Didirri, Maddy Jane, Hooligan Hefs and many more.

Adam is immensely passionate about Australian music. In particular, assisting young artists navigate and overcome the early career struggles that often present themselves. In this episode of Negotiation in Real Life, I speak with Karen Vickers. Karen is the CEO of ARC Wealth, which holds an Australian Financial Service Licence. She is also the Founder of Auxilliam – Before the Fall, which provides Aged Care Financial Advice to families when their elderly parents have had a fall, either mentally or physically, and are no longer able to live at home.

Karen has been in the financial services industry for over 30 years during which time she has helped many families navigate not only the financial but also the emotional complexities that families face when transitioning into Residential Aged Care.

During Covid, Karen experienced firsthand, how very vulnerable our elderly people are, when a very dear friend of hers was diagnosed with dementia without having Powers of Attorney in place, without having anyone to advocate for her and without any close family members nearby.

This in only one of the stories that Karen has experienced, and it is these stories that drive Karen to advocate for and support our elderly family members.

Doug’s work carries him from international work to helping people resolve deep interpersonal and ideological conflicts to training life inmates to be peacemakers and mediators in maximum-security prisons.

His fourth book, De-Escalate: How to Calm an Angry Person in 90 Seconds or Less, was published by Beyond Word Publishing in September of 2017. De-Escalate is now in four languages and its second printing.

He is the co-founder of Prison of Peace, and creator of the Noll Affect Labeling System. In 2012, Doug was honored by California Lawyer Magazine as California Attorney of the Year.

Negotiation in Real Life - Episode 21 - Nicole shares some of her real life negotiation stories

In today's episode of Negotiation in Real Life, we've got something a little bit different. Rather than interviewing another guest on the show, today, I'm going to be sharing a couple of stories of different negotiations that illustrate some of the challenges with the way that businesses currently resolve their commercial disputes.

I look at two examples of disputes where legal intervention has either caused issues or has been avoided to get to a quick and commercial settlement of the negotiation. These stories are based on real disputes that I have been involved in, but I have changed the names, the industries, the amounts and all other relevant details to protect the identity of my clients. I hope you enjoy listening to these stories.

In today's episode, we just start with the idea of the challenges in the legal system. But in our next episode, I'll keep moving forward with some possible solutions to how we might address these challenges better going forward.

In this episode of Negotiation in Real Life, I speak with James D’Apice.  James is a corporate and commercial litigator with Chamberlains law firm.

While knowledge is all well and good, approachability is fundamental to James’ practice. Whether he’s before a judge, dealing with an opponent, assisting a colleague, or advising a client – he prides himself on making sure the right message gets through.

His approachability, combined with his knowledge, sees James regularly recognised as a prominent member of the legal profession.

James uses his skills to help companies, trusts and partnerships (and the people in and around them like directors, trustees, shareholders, partners and beneficiaries) protect and, where necessary, project their interests. This will often involve Court work where James is equally happy “on his feet” before the judge, or serving as part of a team, along with a barrister or two.

In 2018, James kicked off a revolutionary series of videos called “Coffee and a Case Note” giving casual, brief reports on recent legal cases over a cup of coffee. The series continues to this day. He also actively manages a YouTube channel, Instagram page, Twitter account, Facebook page, TikTok page and podcast sharing knowledge about recent decisions.  In his off time, you might find James recording his horror movie podcast “Spooko” or reminiscing about the days when he used to make rap music.

Fionn also really cares about diversity in the profession and believes that law attracts people who thrive when they can live a life of service and integrity. What matters to her is creating a world in which leadership brings freedom to lawyers of all walks of life. In this way she believes in the unlimited potential of lawyers to create a new way of working so they can do the work they love, live the life they want, and serve their community in meaningful and valuable ways.
