Intellectual property covers various types of creations such as inventions, artistic works, designs, trademarks, and trade secrets. Intellectual property rights grant the creators or owners of these creations the exclusive right to use, sell, license, or otherwise exploit them. However, intellectual property is not static, it evolves with the changing needs and challenges of society, technology, and the economy. In 2023, there were many developments and controversies in the IP field. So, what was the top IP highlight for 2023? Well, according to our survey, the most controversial topic was the issue of IP ownership from AI-generated content. Artificial intelligence (AI) is the ability of machines or software to perform tasks that normally require human intelligence, such as learning, reasoning, and creativity. AI has been advancing rapidly in recent years and has been applied to various domains, such as healthcare, education, entertainment, and of course, IP. AI can generate content that may qualify as intellectual property, such as music, art, literature, or even inventions. But who owns the IP rights to these AI-generated creations? Is it the human who designed, trained, or operated the AI system? Is it the AI system itself? Or is it no one at all? This complex and unresolved question has sparked a lot of debate and litigation in 2023. So, what's your opinion? Should AI be able to own IP rights? Or should IP rights be reserved for humans only? Adire and Aso Oke are traditional fabrics that have been produced and worn by the Yoruba people of Nigeria for centuries. Adire is a tie-dyed cloth that uses indigo dye and resist-dyeing techniques to create various patterns and motifs. Aso oke is a hand-woven cloth that is used to make men's gowns, hats, women's wrappers, and head ties. Both fabrics are part of the rich cultural heritage and identity of the Yoruba people, and they reflect their history, values, and aesthetics. However, these fabrics are now facing a serious threat from Chinese counterfeiters, who have been copying their designs and producing cheap imitations that are smuggled into Nigeria. Copyright Protection of Confidential Information: Abdulmumineen Onilemarun v Coca-Cola Nigeria Plc

The case of Abdulmumineen Onilemarun v Coca-Cola Nigeria Plc and the Nigerian Bottling Company is a recent example of a successful lawsuit against a multinational corporation for copyright infringement in Nigeria.

The plaintiff, Abdulmumineen Onilemarun, claimed that Coca-Cola and its bottler used his calendar work on Ramadan timing for dawn meal and breaking of fasting in Kwara State without his consent, license, or assignment.

The court ordered Coca-Cola and its bottler to pay N3 million (about $4,000) to the plaintiff as compensation

A copyright infringement case can have a variety of outcomes, depending on the specifics of the case. A walkie-talkie app that enabled the transmission of voice and video communication is at the centre of a #patentinfringement. Sometime in 2020 #voxer filed a #patent infringement suit against #Meta the parent company of #Facebook and its subsidiary #instagram over 5 of their #patents push-to-talk app which was invented to solve battlefield communications problems. Years after negotiations failed  Facebook platform launched #facebook live in 2015 and later to the general public, US iPhone users in January 2016 and Instagram live in 2016 using voxers' products and tech to achieve this. When the trademark opposition is too close to home, what do we do? In this episode I discuss 3 cases which highlight the interference of a family member regarding owning an intangible asset.


Our case study for episode 82 of #IPSERIES features a dispute emanating from the opposition of a trademark application and an already registered trademark being challenged on grounds of abandonment.


In the first case of Muhammed Ali v Laila Ali, the daughter of the late American Professional boxer application to trademark her name was opposed by the licensing company who had bought the trademark, name and likeness of Muhammed Ali.


The second case features a dispute between a mother and her son who happens to be a 23 year old professional basketballer over his name "LUKE DUNCIC" . What would be the fate of this case which is too close to home?


The final case happens to be a dispute on trademark opposition from a former business partner who is opposing the use of a family business name "ENG's that has been in existence since the 1960's.
