How much veterans receive in disability compensation depends on how the U.S. Department of Veterans Affairs (VA) rates your service-connected disability or condition.  If you have more than one service-connected condition, the amount of monthly compensation is based on your combined disability rating.  To be eligible for VA disability compensation, you must submit a claim, establish a service connection for at least one condition related to your military service (whether on active duty, active duty training, or inactive duty training), and have VA approve your claim and assign a disability rating for that condition.  VA assigns a disability rating based on the frequency, duration, and severity of symptoms. VA makes a determination about the severity of your disability based on the evidence you submit as part of your claim, and/or from military records. Deep-dive: CFR Title 38, Part 4, the Schedule for Rating Disabilities 6. Do NOT have your best day…this does NOT mean to lie/stretch the truth! 7. Be “UNCOMFORTABLY VULNERABLE…”  8. Mental Health Conditions: Occupational/Social Impairment + Symptoms! 9. Any Other Conditions: Pain/Limitation of Range of Motion + Symptoms! 10. How was your disability caused/made worse by your active-duty service? ***How will I know if I got a favorable C&P exam?***  A favorable VA C&P exam will contain a “Nexus” statement, which at a minimum should state, “at least as likely as not” due to a veteran’s military service or another service-connected disability for secondary service connection.  If you see any statement such as “less likely” or “not likely” this is a signal that you had an unfavorable C&P exam and could be denied VA disability benefits. ***What should I do if I had a bad C&P exam?***  The good news is you can get a new exam, but you must take some specific actions to make that happen.  #1. Immediately call the VA general phone number at 1-800-827-1000, speak to a representative, complain, and ask him/her to make a note in your record for the VA regional office in your state.   #2. Write a Memorandum of Record (MFR) and upload it to VA.gov right after after your bad c and p exam (Stick to the facts: Who, What, When, Where, Why, How)  #3: Call the White House VA Hotline and ask for a new C&P exam: 1-855-948-2311. Calls are answered by a live agent 24 hours a day, seven days a week, 365 days a year.    #4. Before the diagnosis of Fibromyalgia can be made, the muscle pain must be present for longer than three months.   There is no blood test, or X-ray can tell if you have Fibromyalgia. The diagnosis is made solely by taking a history and doing a physical exam. During the exam, pain must be occurring at specific sites on the body called tender points. There are 18 of these sensitive spots. GERD is most often rated under CFR 38, Part 4, VA Schedule of Ratings, Diagnostic Code 7346, Hernia Hiatal.  - Common Symptoms of GERD in Veterans -  * A burning sensation in your chest (heartburn), usually after eating, which may worsen at night * Chest pain * Difficulty eating and swallowing * Regurgitation of food particles or sour liquid * Sensation of a lump in your throat - GERD Secondary to PTSD & PTSD secondary to GERD -  Many veterans with GERD or acid reflux, especially those who were diagnosed long after leaving the military are eligible under the law for GERD secondary to PTSD. What is Chronic Pain - Chronic Pain is long lasting pain which interferes with your daily life. It begins to qualify as chronic once it lasts over six months. In some cases, chronic pain is persistent for years of someone’s life.  Chronic Pain can be linked to a number of different reasons, including injury, disease, or damage to nerves. Chronic pain is a condition which directly affects someone’s mental health. Through anxiety, lack of sleep, hopelessness, and depression chronic pain can reveal itself.  How to prove Chronic Pain - Another step in this process is establishing credibility. One way you can do this is by proving that you have tried to relieve the pain in other ways. This could be done with some approaches, including massage therapy, seeing a chiropractor, or visiting with a pain specialist. How to file - Chronic Pain can be submitted as a primary or secondary to other service related conditions.  With this, you will need to understand how primary and secondary claims are rated.  First off, when filing the initial primary claim, you have to prove beyond a reasonable doubt, that your military service directly causes it.  Secondly, to keep your current rating or increase it from the VA, you have to prove, that is has created your “quality of life” and “impairment to your earning capabilities”, and has progressively gotten worse over time.
