VA Disability Migraine Claims in 2020, What You NEED to Know!***  What is a Migraine Headache VA Claim?  Let’s start by exampling what a Migraine headache is. Migraine headaches are intense and severe; often having other symptoms in addition to head pain.  Some symptoms include nausea, pain behind one eye or ear pain in the temples, seeing spots or flashing lights, sensitivity to light and/ or sound, temporary vision loss, and vomiting.  How do I file a Migraine VA Claim? Now to tell if you’re eligible by law, you need to have all of these three:  #1. Get a medical diagnosis of your migraine headache with medical evidence supporting your migraine headaches. If you don’t have one, get your butt to the doctor!!!  #2. Next, your headaches were either caused or worsened while on your active duty military service.  #3. Lastly, there must be a link or the instance or multiple instances caused to have your symptoms of Migraine Headaches you are experiencing today. You have probably heard the terms service dog and assistance dog before, but do you know what these terms truly mean? Generally speaking, a service dog or assistance dog is a working dog specially trained to help a person or group of people with a disability or specific needs. Under the ADA, service dogs cannot be denied entrance to businesses, even food service establishments, state and local government facilities or nonprofit organizations that serve the public. However, service dogs must be under control at all times. #58: Back Pain, What You NEED TO KNOW to Maximize Your VA Disability Rating!

BOOM!   Are you finally ready to get the VA disability rating and compensation YOU deserve?  Complete our 3-step intake and get started now for FREE: http://www.vaclaimsinsiderelite.com ***Back Pain, What you need to know to maximize your VA disability rating!***  How are VA claims for back pain rated?  Many veterans suffer from various back conditions due to their active duty military service and perhaps you’re wondering if you can get VA disability for back pain.  Generally, VA disability ratings for back pain range from 10% to 100% and depend upon the frequency, severity, and duration of symptoms, including Painful Motion, Limitation of Range of Motion (ROM), and Functional Loss or Impairment.  What is the “Limitation of Range of Motion” for VA disability for back pain? The limitation of the range of motion principle is arguably the most important principle that applies to VA disability ratings for back pain. Why? Because the general rating formula for diseases and injuries of the spine talk about “flexion,” which is the act of flexing or bending.  Any limitation of Range of Motion (ROM) should be measured with a Goniometer by the medical professional at your VA C&P Exam for Back Pain.  You must be open, honest, and truthful at your C&P exam for back pain, and make sure to STOP the C&P examiner as soon as you feel any pain. If you can’t move at all without pain, make sure to let the examiner know that.  Can I be rated for more than one VA disability for the back?  In some situations, you can be rated for more than one disability condition for your back that causes different levels of impairment and is clearly separately rated conditions. For example, you may have a 50% VA rating for your back due to unfavorable ankylosis of the entire thoracolumbar spine. As of February 19, 2019, you have the option of having your first-time claim or a supplemental claim reviewed without filing an appeal with the Board of Appeals. If tension and stress on this bowstring become too great, small tears can occur in the fascia. The C&P exam doctor did not know that Migraines could be a secondary condition to Tinnitus and I wanted to walk through that DBQ  Also, a new C&P exam was requested and the new C&P doctor was veteran-friendly and my friend thinks he got a much better shake and the C&P doctor agreed that Migraines are linked to Tinnitus and she provided peer reviews along with her exam.   There is a second DBQ in here for shin splints and I wanted to walk through that one as well to show you how this Bad C&P examiner blew those off as well even though objective medical evidence was provided.

#34: EASY Ways to Service Connect Your VA PTSD Claim [Fast!]

This traumatic event is called a PTSD stressor by the VA.  It is estimated that veterans are four times (4x) as likely to have or develop PTSD compared to those who didn’t serve in the military–a truly shocking statistic.  It’s reasonable to assume a veteran will pursue a VA claim for PTSD at some point, and this post will help you on your path to service connection for PTSD. The VA states a stressor involves exposure to death, threatened death, actual or threatened serious injury, or actual or threatened sexual violence.  The exposure can be related to:  Direct exposure  Indirect exposure, such as learning that a close relative or close friend was exposed to trauma  Witnessing in-person  Repeated or extreme indirect exposure to details of the event  For rating purposes, the VA classifies PTSD as either (1) PTSD Combat or (2) PTSD Non-Combat. Examples of PTSD combat stressors  • Rocket and mortar attacks in Iraq  • Enemy ambush in Vietnam  • IED event in Afghanistan  • Flight deck plane crash in the Gulf War  • Seeing another service-member killed while deployed  Examples of PTSD non-combat stressors Military Sexual Trauma (MST), assault or harassment  • Service-member suicide  • Serious car accidents  • Training accidents  • Witnessing a rape  • Serious weather event such as a hurricane  • Death of a family member How to Prove Your Service-Connected VA Claim For PTSD  Stressor verification is a huge deal for VA disability claims for PTSD.  The reality is if the veteran can’t prove their PTSD stressor on an “at least as likely as not” basis, you’ll likely be denied service connection.  This is also referred to as “corroboration” of a claimed stressor.  By definition, “corroborate” means “to support with evidence or authority and make more certain.”  The VA has different rules to assess whether a stressor event needs further verification.  But in our experience, I want to make something very clear to veterans seeking service connection for PTSD: The burden of proof is on YOU to show on an “at least as likely as not” basis that the stressor event happened to YOU. 👉 Get FREE VA claim resources at our website: https://vaclaimsinsider.com/ 🚀 Check out the VA Claims Insider blog here: https://vaclaimsinsider.com/blog/

It’s believed that 30% of Vietnam veterans have had PTSD in their lifetime. How Many Veterans Have PTSD MST?  Sadly, another common cause of non-combat PTSD in the military is referred to as PTSD MST, which stands for Military Sexual Trauma (MST).  This is any form of sexual harassment or sexual assault that occurs on active duty. MST can happen to both men and women and can occur during peacetime, training, or war. Among veterans who use VA health care, it is reported that:  23 out of 100 women (or 23%) reported sexual assault when in the military.  55 out of 100 women (or 55%) and 38 out of 100 men (or 38%) have experienced sexual harassment when in the military. According to the VBA’s statistics reported to congress, PTSD was the #3 most commonly claimed VA disability, with 1,753,091 veterans (of 4,743,108) receiving VA compensation having a service-connected PTSD VA rating at 0 percent or higher. Those terms are synonymous with depression and anxiety in veterans. These three terms all mean the same thing when it comes to VA claims for mental health. What is a Lifestyle Impact Claim?   I consider this a high-value va claim and if you meet the criteria under the law, a Va Lifestyle Impact Claim is something you should consider as you are developing your strategy for veteran benefits.   A Lifestyle Impact Claim is a high-value secondary claim that many veterans are eligible for due to one or more primary service-connected disabilities.   Many veterans, lawyers, and VSOs DON’T know about secondary claims, which are eligible for compensation under the law, just like any other ratable disability.  It is also actually called Somatic Symptom Disorder according to DSM-V, and the VA used to call it “Chronic Pain Syndrome with Depression/Anxiety.”   You are eligible for this if you already have a rating from the VA as 0% or higher, and you have specific, rated, disabilities.   For example, you are rated at 20% for your left shoulder, 10% for your right knee, and 0% for your back. If these disabilities have caused chronic pain and negatively limiting your life, then you may qualify for a secondary claim to mental health. You will need a certification from a Psychologist for Somatic Symptom Disorder, which will link the two together. There are three types of service connection, there is direct service connection, secondary service connection or presumptive service connection and we are going to be talking about secondary service conditions because that is exactly what Chronic Pain Syndrome - Somatic Symptom Disorder is.   Va rates all service-connected disabilities based on your social and occupational impairment and VA will rate you based on how Somatic Symptom Disorder affects your ability to work and your social life. You can get rated between 0-100 for any secondary disability claims you're suffering from as a result of another service connected disability rated by the VA. Tinnitus is the number one easiest VA disability claim to win by the way.  According to the 2018-2019 VA disability claims data, Tinnitus was the most commonly claimed disability for all Veterans.  Your Tinnitus VA Claim can only have one VA rating.  It is either 10% or nothing.  Your hearing loss VA rating depends on several factors, which are listed below.  What is the typical VA compensation for hearing loss or other ear conditions?  Tinnitus VA Rating  Tinnitus is either rated at 10 percent or nothing. There is no unilateral or bilateral factor for your Tinnitus VA rating. Loss of Ears VA Rating  Veterans will receive a 30 percent VA rating for the loss of one ear.  Veterans will receive a bilateral factor and a VA rating of 50 percent for the loss of both ears.  Eardrum VA Rating  Veterans will receive a 0 percent VA rating for perforated eardrum.  If you found this video valuable, please give it a like. I can literally read the VA’s denial letter now: “The veterans active duty service treatment records do not contain any medical evidence or subject complaints of the disability or condition.”  Here’s the deal veterans: You can prove your VA disability claim and overturn previous denials of service connection using something called “lay evidence.”  What is Lay Evidence?  Lay evidence simply means “after the fact evidence” and it must be competent and credible.  “Competent lay evidence” means any evidence not requiring that the proponent have specialized education, training, or experience.  Lay evidence is competent and credible if it is provided by a person who has knowledge of facts or circumstances and conveys matters that can be observed and described by a lay person. VA Lay Statement Examples  1. A personal statement you write on the VA Form 21-4138 documenting how you think your current non-combat Post Traumatic Stress Disorder is due to an in-service sexual assault and stressor event that occurred 20 years ago IS lay evidence.  2. A Buddy Letter written by someone you served with who can shed some light on how your shoulder separation occurred on active duty IS lay evidence.  3. A spousal letter for sleep apnea, which documents what your spouse has witnessed over the years, and the approximate dates he/she noticed your sleep apnea symptoms began in-service IS lay evidence.  4. A current co-worker’s statement in support of a claim describing the severity of your current PTSD symptoms IS lay evidence.  If you found this video valuable, please give it a like. 🎯 Join VA Claims Insider Elite, get over $7,500 worth of bonuses TODAY, and get started on your VA disability claim for FREE: http://www.vaclaimsinsiderelite.com A buddy letter is simply a credible statement in support of a claim, written by a competent individual 18 years of age or older, who has direct, first-hand knowledge of an event or injury, and offers an account of what they witnessed or are witnessing in support of a veterans VA disability claim.  These personal statements can be from a fellow service member, spouse, friend, pastor, co-worker, boss, adult child, or any other competent and credible witness. A buddy letter can be the linchpin to winning your VA disability claim. A VA buddy statement constitutes “lay evidence” under the law, which simply means “after the fact” evidence. The Rating Veteran Service Representative (RVSR) at the VA MUST consider a buddy letter because it’s considered a secondary source of evidence in support of your VA disability claim.  When writing or obtaining a buddy letter in support of a veterans VA disability claim, you can simply use the VA Form 21-4138, Statement in Support of a Claim. The VA Form 21-4138, official .pdf form is still the PREFERRED method of any personal statements according to VA Rating Officials. A great VA buddy letter is short and sweet. Think less is more.   VA Raters are very busy people, so you want to give them the exact information they need, at the moment they need it to help support a Veterans VA disability claim.   In 3-4 paragraphs, you should explain (1) your name, information, and how you know the veteran. 💰 Join VA Claims Insider Elite and get started on your VA disability claim for FREE: http://www.vaclaimsinsiderelite.com  🔥 Veterans, watch my free webinar training here: http://www.vaclaimsinsidersecrets.com ❤️ In this video, Brian Reese the VA Claims Insider explains how to prove your ptsd non combat stressor event.    This video is specific to veterans who want to learn about ptsd non combat claims, ptsd va rating, non combat ptsd, ptsd rating scale, ptsd disability rating, ptsd dbq, and 70 ptsd rating.    Recently at VA Claims Insider we’ve seen a string of non-combat PTSD denials because the veteran “failed to corroborate that the veteran was actually present and witnessed the non-combat PTSD event.”   For example, a Navy veteran had (1) A medical diagnosis of PTSD and was seeking treatment, (2) A personal statement (lay statement) in support of the PTSD claim, (3) A newspaper article about the hurricane event to confirm the stressor event, and (4) A “buddy letter” explaining that the event did in fact occur.  At first glance, it might seem like this should have been a slam dunk case for non-combat PTSD. Not so fast. The veteran didn’t even get a Compensation and Pension (C&P) exam tips and the VA denied the claim. Why? Because the veteran “failed to corroborate that the veteran was actually present or witnessed the non-combat PTSD event.”   In ALL PTSD non-combat situations you MUST have a buddy letter from a first-hand witness who can corroborate (aka, verify and validate) that YOU were physically present and that you witnessed the stressor event occur.   It’s NOT enough to simply confirm that the event occurred … you must confirm you were there and witnessed the event, aka, the stressful event happened to you, which in VA speak means “at least as likely as not.” The first evidence source is something called “Primary Evidence.”  Primary evidence is generally considered the most reliable source for corroborating in-service stressors and should be carefully reviewed when corroboration is required.    Primary evidence includes:  Service personnel records and pay records Military occupation evidence  Hazard pay records Military performance reports Verification that the Veteran received Combat/Imminent - -  Danger/Hostile Fire Pay Unit and organizational histories Daily staff journals Operational reports-lessons learned (ORLLs) After action reports (AARs) Radio logs, deck logs, and ship histories Muster rolls Command chronologies and war diaries, and Monthly summaries and morning reports.
