In this week's episode of Clearing The Haze, we talk about the sale of CBD at the cash registers of numerous truck stops. This becomes a confusing issue for truck drivers thinking it's okay for the to purchase because it's readily available for them to purchase without warning.
What can we do to protect our clients or others who are misunderstanding that they are not able to have this as a safety-sensitive classified employee?
The warning that came out is pretty clear, it may be talking with our clients or having the notice readily visible in our testing sites that can make a difference. What Do You Mean They Have A Fine For That? _080
In this episode of Clearing The Haze, We talk about an FMCSA Rule that some may have forgotten in recent years.
In May of 2012, the Us department of Transportation Federal Motor Carrier Safety Administration FMCSA introduced a new rule, No texting while operating a CMV. In that rule, the FMCSA gave an overview and background of the problem, explained precisely what texting was and what the result of this new rule would be.
That result was to put CMV drivers on notice that if they were texting and driving, they would face fines and penalties that could include driver disqualification, and penalties up to $2500 for drivers and $11,000 for employers who allow or require drivers to use handheld communication devices for texting while driving
Drivers with multiple convictions for texting while driving a CMV could result in a driver disqualification by FMCSA and face State law violations for operating or driving a CMV the could cause serious traffic violations resulting in the driver being disqualified for a first offense up to 120 days

Bottom line, as the drug testing technician, it is our job to follow the process of drug testing to the letter. If you suspect adulteration or synthetic urine use follow the steps in CFR part 40- 40.57 (C) to understand what your responsibilities as a collector are and how to document the incident you're suspecting of being adulterated.

It's not uncommon in a service business to have customer who can become unhappy or frustrated with your services for a multitude of reasons. Today, many of those individuals will respond by posting reviews of your service on social media in an attempt to tell their story and at the same time damage your company or reputation in the process
How do you deal with this?
In this episode, we talk to address this and how to respond to protect you and your business. In most cases, a negative review can be positive when potential clients call and ask about when they have read or were sent by someone giving you the opportunity to explain what occurred. We talk about other options and why responding on social media could be more damaging than saying anything at all.

The Confusing Issue For Employers- Do We Test For Marijuana Or Not? _078
Do you continue to test for Marijuana in the workplace or not? We have recently seen an increasing "relaxed" stance on testing for Marijuana, more so in companies choosing NOT to Pre-Employment test for Marijuana saying that they are unable to find qualified applicants who can pass a drug test if they include Marijuana. What is more concerning and confusing, especially for employees is these same employers WILL test for Marijuana for Reasonable Suspicion or Post-Accident situations.
We have had many employees refuse a test for reasonable suspicion or a post-accident citing not being tested for Marijuana when they got the job, so why are they worried about it now? Great question! This is continuing to be a major hurdle for employees and will become even more complicated with many states now in the process of legalizing Psychedelic drugs for the treatment of PTSD and other medical conditions.

This week on Clearing The Haze, we talk with David Bell, CEO of USA Mobile Drug Testing LLC. After seeing the damage caused by drug use first-hand, David Bell sold his previous company and worked his way up through the ranks in the drug and alcohol testing industry with the mission of helping employers keep drugs and alcohol out of the workplace. He joined USA Mobile Drug Testing, LLC in Tampa, Florida in 2012 as vice president of sales and marketing and has served as CEO of USAMDT since 2014.
USAMDT has more than 3,500 collection facilities and 400 mobile collection specialists throughout nationwide. In 2007, it became the first screening service that offered to bring certified, full-compliance specialists directly to employees, thereby providing cost and time savings to employers. David has authored many articles and is frequently invited to speak about keeping drug use out of the workplace at business and industry events.
David also has been featured by numerous business and trade publications for his expertise on the topic. David is an active volunteer for his church and various charitable causes. He previously served on the Drug and Alcohol Testing Industry Association (DATIA) membership committee, the NDASA governmental affairs committee, and spent a day in Washington DC, meeting House members and administration staff and talking to them about a safety carve out for proposed drug legislation.
