How Are Autonomous Vehicles Regulated? w/ Alex Glassbrook

It might sound like the distant future, but the use of AI in transport is already a reality. 

A British barrister at Temple Garden Chambers, Alex Glassbrook works at the intersection of law and technology of the infrastructure that moves us from A to B: transport. His practice includes the law of advanced, automated and electric vehicles, serious personal injury cases, motor insurance law (including counter-fraud work) and high-value vehicle damages claims. In this episode, he explains how he got into technology law, the regulation of driverless cars and the current obstacles around regulation. We also discuss the history of transport regulation and what we can learn from the past. 

Since we recorded this episode, the UK Automated and Electric Vehicles Act 2018 was brought into force on Wednesday 21st April (by the AEV Act 2018 (Commencement No.1) Regulations 2021, SI 2021/396). There is currently no list of automated vehicles which the Act can apply to, but it is speculated that the Secretary of State will publish the list soon, as section 1 of the Act requires.

Noah Waisberg is the co-founder and CEO of the legal artificial intelligence (AI) company Kira Systems. Previously, Noah was a corporate lawyer at Weil, Gotshal in New York. He is an expert on contract analysis, legal technology, and artificial intelligence, has spoken at multiple conferences, and has been named the FT's Intelligent Business Market Shaper in 2018 and ILTA's Innovative Thought Leader of the Year.  He is also one of the authors of AI for Lawyers, now a Wall Street Journal best seller.  

In this episode, Noah and I spoke about how he got into legal tech, how AI applies in the legal space, use cases legal teams can be inspired by, utilise and replicate, and why AI's usage is not going anywhere.

Smart Contracts w/ Luigi Cantisani | Working As A Lawyer at Futura Law Firm And As A Legal Engineer

Luigi Cantisani, is a Junior Lawyer at Futura Law Firm where he is assisting a number of technology startups. His role also encompasses working alongside teams, assisting with legal engineering as part of Jur. 

Luigi is also taking his Ph.D. in Law at the University of Warwick, researching "Blockchain-based Platforms and the Rise of Peer-To-Peer Transactions: Impacts on International Contracts and Trade". A commonly misunderstood topic, Luigi is closer to the scene of smart contracts and how the new technology could change how contracts are executed, also lecturing on the topic. 

In this episode, we discuss Luigi’s current role, including Luigi’s work as a legal engineer. We then look at what is a smart contract, some common use cases in practice, and where legislation comes in. Finally, Luigi gives his advice for students to work alongside startups or within the technology space.

This week we spoke to polyglot and multi-talented Karol Valencia, Legal Services Designer, and Business Innovation Strategist at Lawcus-LPM and Legal Project Leader at eID. Karol's design work looks at law school education systems: she is the coordinator for Peru of the ILSA Alliance, while also a digital transformation lecturer at Wenex Formación by Adams. Karol also works alongside a number of legal tech startups and is a recent EWOLT winner.

In this episode, we focused on legal design, what it means to Karol and why and how it can be important to improve access to justice. We also explore Karol’s future plans to use voice interfaces in design to improve accessibility. This leans on Karol’s experience as a founding member of the A11YPeru community, the first digital and inclusive accessibility community in Peru. Karol also shares several educational resources for those interested in the legal design space.

Dan Grant Smith is Head of Engagement at Legatics, a transaction management program. Erika Federis is part of legal counsel at digital payments platform Wirex. While training as a lawyer she was introduced to the area of blockchain and cryptocurrencies during her training contract. Since discovering her passion for the space, Erika has written articles on the topic on Cointelegraph, Medium, Fintech Direct and Blockchain news and continues to follow the development of cryptocurrency regulations across the globe.

After graduating from Warwick Law School, where she also studied abroad at Monash University, Elizabete Ludborza now works in Legal at eBay Luxembourg. 

In this episode, we discuss Elizabete’s responsibilities at eBay, life at the company’s office in Luxembourg and how her past experience of running a blog has helped her in applications and in developing technical skills. Elizabete also shares some useful resources and online courses for legal tech enthusiasts.

Shaping our legal futures w/ Erika Ly | The Legal Forecast | Responsible AI

Erika Ly operates at the nexus of law, technology and society. Her work focuses on the design and regulation of artificial intelligence and she is passionate about interdisciplinary innovation. Her current positions include being Secretary of the Australian Society for Computers and the Law and a Director at The Legal Forecast. Prior to this, Erika started her career as a 'Technolegal' at Gilbert + Tobin, a leading Australian commercial law firm and worked at one of Australia's first legal technology startups, LawPath. She is also proud alumna of the global LawWithoutWalls community.

In this episode we discuss what the future may hold, the theme of responsible AI and  'ethical AI' and some of Erika's latest work. We address The Legal Forecast, which is an Australian not-for-profit community of law students and lawyers passionate about legal innovation. Erika also explains her recent participation at the inaugural Berkman Klein Center for Internet & Society Summer Institute, where the team's focus was indigenous people's interaction with the digital world. Throughout the episode we also draw on some of Erika's past experiences such as acting as an advisor and consultant to the Law Society and the Supreme Court of NSW.

Wire Less: Internet Blackouts w/ Natalia Krapiva | Access Now | Belarus | Human Rights Law

If you are reading this then you must have had internet access in the past few minutes. But what if this connection was a fleeting glance? 

This episode is with Natalia Krapiva, Human Rights lawyer and Technology Legal Counsel from Access Now. Access Now has the mission of improving society's digital rights through awareness, advocacy and campaigning. While internet shutdowns are an increasingly common phenomenon, the reduction of the internet to 20% of normal capacity in early August in Belarus is propelling more discussion around the topic. 

In this episode we discussed what is an internet shutdown, what risks it poses to society and how the shutdown was facilitated in Belarus. After, we look closer at the work Natalia has recently been involved in: litigating in the ECOWAS Togo court, successfully proving that an internet blackout infringes the right to freedom of expression. But the work isn't just for lawyers and Natalia provides ways for society to raise awareness of the issue.

Hannele Korhonen is a Finnish legal designer who runs her own legal consultancy, Villa Verto. With over 20 years of Contract Law experience, Hannele has the aim of changing the world for the better, improving how lawyers work with contracts and how society interacts with the Law. This is through using Legal Design, a skill she teaches lawyers at her design school to utilise in their practice. Hannele also shares insights into using Legal Design to reimagine the practice as a lawyer on her blog Something Simple First. 

In this episode we focus on what Legal Design is and the work Hannele is doing through Villa Verto's Social Impact Hub. We discuss how Hannele is working on a Legal Design project for Plan International, looking to improve the options available to and the Law supporting immigrant women and girls.

Goodbye Privacy Shield: Schrems II in the CJEU w/ Tobias Bräutigam

Practicing at firm Bird & Bird, Tobias Bräutigam is Senior Counsel and Head of the Privacy and Data Protection group in Helsinki. In the past Tobias 
has also worked as Senior Legal Counsel at  Microsoft and Nokia.

In this episode Tobias and I analyse the decision Schrems II and discuss the business and societal impacts. Tobias also explains what drew him to  Law and Technology and where Data Protection Law may move in the future.

SCHREMS II: 

On Thursday 16th July 2020, the European Court of Justice heard the case of Schrems II, which concerned the legality of international data transfers. Overall, the judgement ruled that the US-EU Privacy Shield is not a valid way to transfer data between the EU and US, and more suitable means would need to be used. For an overview of what discussion points there were prior to the hearing, you can read Tobias' analysis here on LinkedIn.
